1. About Fresh Map

Fresh Map ("Fresh Map," "we," "us," or "our") is a local food discovery platform that helps consumers find farms, farmers markets, natural grocery stores, CSA programs, and health-focused restaurants in their area. Fresh Map is operated by Ethan Bhageloe and is based in Florida.

These Terms of Service (the "Terms") are a binding legal agreement between you and Fresh Map that governs your access to and use of our website and services (together, the "Platform").

2. Acceptance of These Terms

By clicking "I agree," creating an account, submitting a listing, subscribing to our emails, or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Platform.

We may revise these Terms from time to time. The "Effective date" above shows when they were last updated. Your continued use of the Platform after a change takes effect means you accept the revised Terms.

3. Who Can Use Fresh Map

You must be at least 13 years old to use the Platform or create an account. By using Fresh Map, you represent that you meet this requirement. If you are under 18, you represent that you have permission from a parent or legal guardian. The Platform is intended for users in the United States.

4. Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at hello@freshmap.app.

5. Vendor Listings — We Do Not Verify

Most listings on Fresh Map were written by us, not by the vendor. Unless a listing shows that the vendor has claimed it, the description and tags were compiled by Fresh Map from publicly available sources — the vendor's own website, public directories, and market listings — and were not supplied, reviewed, or approved by the vendor. They may be incomplete, out of date, or wrong.

We do not verify, certify, inspect, or endorse any vendor, or any vendor's claims about their food, standards, certifications, pricing, hours, availability, or practices. Descriptive tags such as "grass-fed," "organic," or "no-seed-oils" are informal category labels used to help you search. They are not certifications, they do not mean a vendor holds any certification or meets any government or private standard, and we do not independently confirm them.

Listing details — including hours, open/closed status, and location — may be inaccurate or out of date. Always confirm directly with the vendor before you travel, purchase, or make any decision based on a listing. Fresh Map is a discovery tool — not a marketplace, seller, agent, or party to any transaction. We do not process payments, fulfill orders, or take responsibility for any dealings between you and a vendor.

6. Food Safety, Cottage Food & Assumption of Risk

Food purchased from vendors you discover through Fresh Map is produced, handled, and sold entirely by those vendors. Some listings are home-based producers operating under Florida's Cottage Food Law (§ 500.80); these sellers are not licensed or inspected by any state or local food-safety agency. Some vendors may offer raw, unpasteurized, fermented, or other higher-risk products. Florida law prohibits the retail sale of raw (unpasteurized) milk for human consumption, and Fresh Map does not authorize or facilitate any unlawful sale.

You assume all risk associated with obtaining and consuming food from vendors found through the Platform, including risks of foodborne illness, allergens, and mislabeling. You are responsible for confirming a product's ingredients, handling, licensing, and suitability for your needs directly with the vendor. Fresh Map is not responsible for the safety, legality, or quality of any vendor's products.

7. Not Medical or Nutritional Advice

Nothing on Fresh Map is medical, dietary, or nutritional advice. Tags and descriptions are informal labels that help you search — they are not health claims, not statements about nutritional content, and not a promise of any health outcome. Consult a qualified healthcare provider or registered dietitian for personalized guidance.

8. Content You Submit

If you submit a listing, correction, photo, or other content, you represent that you have the right to do so and that the content is accurate and does not infringe anyone's rights. You grant Fresh Map a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and promote the Platform. You are responsible for the content you submit, and we may edit or remove any content at our discretion.

9. Copyright & DMCA Takedown

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, or that a listing uses your name, likeness, or business information without authorization, send a notice to hello@freshmap.app with "DMCA" or "Listing Removal" in the subject line. Include: (a) identification of the work or listing; (b) its URL; (c) your contact information; (d) a statement that you have a good-faith belief the use is unauthorized; and (e) your physical or electronic signature.

We act on valid removal requests promptly, and we maintain a policy of removing content and, in appropriate circumstances, terminating users who repeatedly submit infringing material.

10. Acceptable Use

You agree not to:

• Submit false, misleading, or infringing vendor information or content
• Use the Platform for spam, scraping, or automated data collection
• Attempt to access accounts, systems, or data that do not belong to you
• Interfere with or disrupt the Platform
• Use the Platform in any way that violates applicable law

11. Intellectual Property

All Fresh Map branding, design, and original content is owned by Fresh Map. Vendor names, descriptions, and publicly available information remain the property of their respective owners. You may not reproduce or distribute Fresh Map content without our written permission.

12. Third-Party Links & Services

The Platform links to vendor websites and other third-party services we do not control. We are not responsible for their content, products, or practices, and your use of them is at your own risk and subject to their terms. If we ever earn a referral or affiliate fee from an outbound link, we will disclose it clearly at the point of the link.

13. Disclaimer of Warranties

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that vendor information is accurate, complete, or current, or that the Platform will be uninterrupted or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, Fresh Map and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Platform or your dealings with any vendor. Our total aggregate liability for any claim relating to the Platform will not exceed one hundred U.S. dollars ($100.00).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for gross negligence, willful misconduct, fraud, or personal injury where such limitation is prohibited by Florida law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Fresh Map and its operator from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your content, or your violation of these Terms or applicable law.

16. Dispute Resolution

Before filing any claim, you agree to first contact us at hello@freshmap.app and give us at least 30 days to resolve the dispute informally.

To the extent permitted by law, any dispute will be brought only in your individual capacity, and not as a plaintiff or class member in any class or representative action. You and Fresh Map each waive any right to a jury trial.

17. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Leon County, Florida, and you consent to their jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform. Continued use after changes take effect constitutes acceptance of the updated Terms.
